When LSPs
assert Down-Gradient Property Status (DPS) on behalf of
their clients they must base their assertion on reasonable
assumptions and on appropriate data.
MassDEP has audited a number of sites where DPS
assertions are based on questionable assumptions and
either inappropriate or insufficient data, and some of
these cases have been forwarded to the LSP Board as
complaints against the LSP and resulted in license
sanctions.
The
purpose of this workshop is to use several case studies to
explore DPS practice issues from MassDEP and LSP Board
perspectives.
